Your personal information collected or provided on this site is intended for the Régie des Transports Métropolitains (RTM), which is responsible for processing it within the meaning of the amended Data Protection Act, and whose registered office is located at 79 Boulevard de Dunkerque, 13002 Marseille, and more specifically to the RTM departments responsible for the management and administration of the website and its associated services (including in particular the Marketing and Sales Department, the Innovation and Information Systems Department, the Finance and Accounting Department, the Communications Department and the Other New Activities Department). RTM’s designated Data Protection Officer (DPO) may also have access to your personal information in the context of the tasks entrusted to him/her under the European Data Protection Regulation 2016/679 of 27 April 2016.

RTM’s service providers:
As an EPIC, RTM may call upon service providers and suppliers who are “subcontractors” within the meaning of the French Data Protection Act (Loi Informatique et Libertés) and to whom it entrusts the performance of all or part of certain tasks relating to

the technical and functional maintenance of its website
the publishing and hosting of the site;
the supply of the services offered (online sales module, TMA of the IT applications supporting the processing linked to customer relationship management, etc.).
These service providers may have access to, or receive, certain personal data for the exclusive purposes of their missions on behalf of RTM, in compliance with the procedures of the Public Contracts. Some of your data may be transmitted, at their request and in accordance with the legal and regulatory procedures in force, to the authorities and administrations of the justice system, the police and the gendarmerie, to official bodies recognised as authorised third parties by the law and by the CNIL, as well as to any other recipient, public or private, by virtue of the law, a decree or a judicial decision.

 

How do we use your personal data?

On the site, the personal data that may be collected is necessary for the provision of the services offered by the site:

– the purchase of single tickets online for a crossing on the date of your choice,
– the reservation of group journeys,
– sending a message through the contact form,
– the provision, management and improvement of the services and features offered on this site.

For customer service contact and group bookings

The data requested in this Customer Service contact form and marked with an asterisk are mandatory for the purpose of processing your request and are not contractual in nature. They are processed on the basis of your consent and RTM’s legitimate interest in being able to reply to you and process your request. If you do not provide the data, the submission of your request is technically impossible and will be refused by the site.
The submission of the contact form generates the sending of an email to the teams in charge of customer relations.
The email containing your personal data is archived in the mailbox used and will be deleted two years after the date the reply is sent.

    In the context of online sales

    It is possible to purchase tickets online. The creation of an account allowing you to identify yourself is compulsory for the purpose of processing your order (sending the ticket). If you do not provide this information, the purchase of tickets online is technically impossible and will be refused by the website. This data is of a contractual nature and the processing is necessary for the execution of the ticket sales contract.

    The data requested is processed for the following purpose: online ticket sales.
    The contact email is compulsory as it allows us to send by email to the address provided

    – validation of the payment
    The creation of an account by associating a password with your email address is compulsory to enable you to consult the history of your orders, to have access to your e-tickets and to your purchase receipts.

    The identification and contact data are kept for the purpose of facilitating order tracking, purchase history and future purchases. The data will be retained for as long as is necessary to process the customer’s Order and will be deleted two years after the date of closure of the processing of your last request.
    RTM does not store any bank details relating to payments made.

    What are your rights regarding your personal data?

    You are informed that, in accordance with and under the conditions laid down in the legislation on the protection of personal data, you have the following rights with RTM

    • Right to access and obtain a copy of your personal data held by RTM,
    • The right to have your personal data, including your online customer account, corrected and, subject to certain conditions, deleted,
    • The right to obtain information on the conditions of use of your data,
    • The right to object to the processing of your data on grounds relating to your particular situation,

    If you believe that your data is being processed by RTM in breach of its legal and regulatory obligations in this area, you have the right to lodge a complaint with the Commission Nationale Informatique et Libertés (CNIL).

     

    Rules of procedure

     

    Article 1: Conditions of carriage of passengers

    Passengers may purchase their tickets up to 10 minutes before the departure time.
    Seats are not numbered or assigned. One seat per boat may be reserved for PRM access.
    All passengers must present themselves for boarding at least 15 minutes before departure.
    Passengers will board the boat according to the order in which they arrive at the quay. At the end of each crossing, all passengers must get off the boat.
    Each passenger is required to keep their ticket for the duration of the journey, both on the outward and return journey.
    All passengers, in order to board, must undergo the departure procedures (counting and checking of tickets).
    With regard to reduced fares: in the event of non-compliance with the special conditions relating to these fares, the passenger will be liable to RTM for the difference between the price indicated and the normal price.

     

    Article 2: Safety

    Pregnant women may take a sea voyage up to seven months of pregnancy (except residents).
    Children are under the supervision and responsibility of the person accompanying them, who must hold their hand as often as possible.
    If the child is unaccompanied, both parents or legal guardians must fill in a specific form specifying the details of the person who will be responsible for picking up the child and fill in an “Authorisation for a minor child to travel alone” certificate. These documents can be collected from RTM at the Gare Maritime.
    Fuel, flammable, dangerous and/or explosive substances are not allowed on board the boat.

     

    Article 3: Passenger behaviour and dress

    It is forbidden to disturb the peace and safety of passengers or to interfere with the operation of the maritime shuttle.
    During the crossing, passengers must be seated first. It is forbidden for passengers to lean out.
    It is forbidden to throw objects and/or waste of any kind on board the boat or into the sea.
    Smoking, vaping, eating and consuming alcoholic beverages on board the boat are prohibited.
    Proper attire is required on board the boat. It is forbidden to enter the boat bare-chested, in swimwear and/or barefoot.

     

    Article 4: Baggage and animals

    Each passenger is allowed a baggage allowance of 30 kg.
    Above this weight, RTM reserves the right to refuse to allow the said luggage on board the ships. Passengers must have their surname, first name and address clearly marked on their luggage.
    Children’s pushchairs are only allowed on board if they are used to carry children. To gain access to the ship, they must be folded (with children carried) and remain folded throughout the journey.
    Bicycles and non-motorised wheeled objects are permitted subject to the approval of the captain.
    Pets are only allowed on board if they are kept on a leash and muzzled if necessary, on the outside decks (within the limits of the weather conditions). They must not dirty the premises, or inconvenience passengers or constitute a nuisance to them.

     

    Article 5: Conditions for cancellation or delay of a crossing

    In accordance with the texts applicable to maritime transport, if the departure of a vessel is prevented by an event not attributable to RTM (weather, etc.), the company declines all responsibility for the direct or indirect costs and prejudices caused by these modifications.
    The crew is authorised to interrupt the operation of the boat and to take any emergency measures in the event of a technical problem, incident on board or any other event likely to affect the safety of the public, particularly in the event of adverse weather conditions.
    Similarly, RTM cannot be held responsible for the non-coincidence of boat departures and arrivals with any other means of transport.

    Any complaint against RTM must be made within 15 days of the journey.

    General Terms and Conditions of Sale of the regular line 

     

    RTM – lebateau Frioul-If

    Preamble

    The Régie des Transports Métropolitains (hereinafter referred to as RTM), an EPIC registered with the RCS of Marseille under number 059804062, whose head office is located at L’ASTROLABE 79 bd de Dunkerque CS 60478 13235 Marseille Cedex 02, offers boat trips from the Vieux-Port of Marseille to the islands of If and Frioul.
    These general terms and conditions (hereinafter referred to as the “GTC”) are intended to define the terms and conditions of the services offered by RTM.
    They are available on request from RTM at the address indicated in paragraph 15 of these General Terms and Conditions of Sale.
    RTM reserves the right to modify the terms of the GTC at any time. The provisions applicable shall be those in force on the date of sale of the ticket.
    The purchase of a ticket implies the full, complete and irrevocable acceptance by the Client of these GTC, to the exclusion of all other documents, such as leaflets or catalogues, issued by RTM or one of its service providers and partners, which are only indicative.

    1. Timetables and routes
    The timetables are proposed by RTM and validated by the Aix Marseille Provence Metropolis. In the event of a major problem, the planned departure times may be brought forward or delayed by 15 minutes. In the event of major changes to the timetable, itinerary or stopover, RTM undertakes to inform passengers as soon as it is aware of them.

    2. 2. Ticket
    The ticket is only valid for the departure indicated.
    The return journey must be made within the period of validity of the ticket (six months from the date of issue of the ticket).
    If there is no departure date, the ticket can only be used during the six months following the date of issue and depending on the availability of seats. After this period, the ticket will become null and void, even for the purpose of obtaining a refund.
    No special condition other than that of RTM may, unless formally accepted in writing by the latter, prevail over these General Terms and Conditions of Sale. Any clause to the contrary raised by the Client shall therefore, in the absence of express acceptance, be unenforceable against RTM, regardless of the time at which it may have been brought to the Client’s attention.

    3. Fares, payment methods and invoicing
    The prices of transport tickets are indicated in euros.
    The prices are set by deliberation of the Metropole Aix Marseille Provence and may be modified at any time.
    The applicable prices are those displayed on the https://prod.lebateau-frioul-if.fr website at the time of the Customer’s Order.
    Prices include all taxes.
    The prices only take into account the value of the transport tickets.
    Internet connection costs shall be borne by the Customer.

    4. Allocation of Resident / Charterer status
    Specific tickets and fares, established by the Metropole Aix Marseille Provence and distributed by the RTM, are reserved for people with the status of main or secondary resident or yachtsman of Frioul.
    In order to benefit from the adapted ticket, pass and fare, the persons concerned must provide the supporting documents associated with the requested status.
    These documents and the personal data requested in the forms and marked with a star are necessary to verify and validate the status and to allow the application of specific fares.
    This information is of a contractual nature and failure to provide it will result in the impossibility of granting the pass, subscription and tariff adapted to the Customer’s situation.
    The data collected is intended for use by the teams in charge of analysing and allocating status within the RTM’s Other Operating Activities Department.
    The personal information collected or provided within the specific framework of the allocation of resident status (primary, secondary) or pleasure boaters), and the supporting documents provided are likely to be transmitted to the Aix Marseille Provence Metropolis on its request.
    They are kept in paper format for two years, i.e. the duration of the extension of the status, before being destroyed or updated.

    5. Online sales
    The https://prod.lebateau-if-frioul.fr website is published by RTM. The director of the publication is Gil Valabregue in his capacity as Marketing and Sales Director of RTM.

    a) Definitions
    The meaning of the terms used in this document is as follows
    Client : The customer refers to the purchaser of a ticket who logs on to the https://prod.lebateau-frioul-if.fr website.
    Order: The order refers to any request for goods or services made by the Client to RTM
    Ticket: A ticket constitutes a transport contract between the Client and the corresponding passenger transport network. It consists of a ticket.
    Site: the https://lebateau-frioul-if.fr site is, among other things, an e-commerce site accessible via the Internet, accessible free of charge and open to any Customer using the lebateau services.

    b) Purpose
    This chapter concerns the terms and conditions of sale concluded between RTM and a Client, in the context of the remote sale, via the website https://prod.lebateau-frioul-if.fr, of tickets valid on the boat.

    6. Ordering Tickets Online
    The Customer may view the various tickets offered for sale by RTM on its website https://prod.lebateau-frioul-if.fr.
    They may browse freely through the various pages of the site, without being bound by any order. The ordering of tickets on the https://prod.lebateau-frioul-if.fr website is reserved for clients who have read the General Terms and Conditions of Sale in their entirety prior to each order: any order implies the Client’s unreserved acceptance of these terms and conditions.
    The Customer may place an order on the website https://prod.lebateau-frioul-if.fr.
    The Customer first selects the different tickets he/she wishes to purchase, after having consulted their prices as well as the conditions of use applicable to each type of ticket on the website https://prod.lebateau-frioul-if.fr.
    The Customer may display the basket at any time in order to check the tickets selected and the total amount of his/her order and, if necessary, modify the various components of his/her order.
    To purchase a ticket, the Customer must create an account. This is possible during the ordering process (“your account” stage).
    The placing of the order takes place in the following manner:

    a) Managing the shopping basket
    The tickets selected by the Customer are listed in the shopping basket. If the Customer wishes to purchase all of the tickets selected, he/she may confirm his/her order. However, if the Customer wishes to remove one or more of the tickets selected from their shopping basket, they may do so only before confirming their order and making payment.

    b) Registration and validation of the Order
    The Customer chooses the type and quantity of tickets for which they wish to place an order. Any validation of the order is equivalent to the sale of the tickets.
    In order to order the ticket(s) they have chosen, after having selected the quantities per product to be added to their shopping basket, all Customers must identify themselves:

    either if they are already registered, by entering their login and password in the boxes under the heading “Already a Customer ? Login”.
    or if they are not yet registered, by clicking on “new Customer” and entering the requested information and creating their identifier (e-mail address) and password.
    In the latter case, the Customer must accurately complete the form provided, on which he/she must include the information required for identification.
    In addition, the Customer must provide an identifier and password of his/her choice which will be personal and confidential and which he/she will need to identify himself/herself later on the site.
    The creation of an account enabling the Customer to identify himself is compulsory for the purposes of processing his order (sending the ticket). If the data is not provided, the purchase of tickets online is technically impossible and will be refused by the site. This data is of a contractual nature and this processing is necessary for the execution of the ticket sales contract:

    ESending of the order summary ;
    Sending of e-tickets;
    Confirmation of payment validation and proof of purchase.
    Confirmation of registration will be sent by e-mail to the e-mail address indicated by the Customer at the time of identification.
    The Customer is informed and accepts that the entry of this information (identifier and password) is proof of his identity and demonstrates his consent. This information (user name and password) will be mentioned in all correspondence sent from the site (confirmation of the order and confirmation of dispatch of the order) and the Customer accepts that all correspondence will be sent by e-mail to the e-mail address indicated by the Customer. The latter is responsible for the orders made with his/her login and password.
    The identification and contact data will be kept in order to facilitate the follow-up of orders, purchase history and future purchases. The data will be deleted two years after the date of closure of the processing of your last request.
    Once the Customer has been identified, an order form will appear on the screen, summarising the nature and price of the ticket chosen by the Customer, as well as the total amount of the order and the Customer’s contact details.

    c) Final validation of the order
    Once the Customer has made his/her choice and after having read and accepted these General Terms and Conditions, he/she selects the “next” button at the bottom of the order summary and is redirected to a page where he/she can pay for his/her purchase.
    Subject to the applicable legal and regulatory requirements, RTM reserves the right to cancel or suspend, in accordance with the law, any order from a Client with whom there is a dispute concerning the payment of a previous order.

    d) Payment of tickets
    Tickets must be paid in cash by bank card.
    The bank cards accepted are French cards bearing the CB logo (national or international VISA or MASTERCARD cards) and foreign cards bearing the VISA or MASTERCARD logo, accepted in France.
    Payment by credit card is made via a secure payment system using the SSL (Secure Socket Layer) encryption process to protect the transmission of data relating to payment methods.
    Payments made on the https://prod.lebateau-frioul-if.fr e-shop are secured according to the 3D Secure protocol (recognisable by the “Verified by Visa” or “Mastercard SecureCode” logos).
    The debit is made at the time of the online payment on the condition that the user’s account has been authorised to be debited by the competent payment centres. In the absence of this authorisation, the payment cannot be taken into account and the order process will be suspended. Any resulting costs shall be borne by the Client, and RTM reserves the right to take any action against the Client.
    RTM does not retain any bank details relating to payments made by clients.

    e) Confirmation of the order and payment
    Upon receipt of the Client’s order and validation of payment, two e-mails will be sent to the Client’s e-mail address, one summarizing the order and the other confirming payment of the order.
    Once the payment of the order has been taken into account by RTM, the Client may no longer cancel the order. A summary of the order will be prepared and sent to the Client’s e-mail address.
    Consequently, no changes to the order may be made after the said electronic messages have been sent. It is recommended that the Customer keep and/or print these electronic messages as they constitute proof of the order.

    f) Delivery of tickets
    The Customer must print out the tickets purchased online at his/her own expense.
    To do this, the Customer has two options:

    print the ticket directly online after having made the payment,
    print their ticket later using the link that will appear in the two e-mails received as provided in point 4.5.
    The Customer is solely responsible for the e-mail address given in the order. If the Customer does not receive the e-mails referred to in section 4.5 due to an insufficient or incorrect address or due to the Customer’s failure to take due care, the Customer who has not printed his or her ticket directly will not be able to print it later. Likewise, RTM shall not be held liable in the event of a malfunction of the Client’s electronic mailbox.
    Any damage or incomplete shipment must be reported immediately and at the latest within 3 days of the date of the order:
    – by e-mail to the following address: accueil.frioul@rtm.fr
    or
    – by post to : RTM – DE/AAE – lebateau – 473, rue Saint Pierre – 13012 MARSEILLE
    If no reservation or mention is made in the above-mentioned conditions, without prejudice to the applicable legal guarantees, the Order shall be deemed to be compliant.

    g) Refunds for tickets sold on the Internet
    Refunds or exchanges of tickets sold on the Internet may only be made if RTM cancels the timetable on which the passenger was due to travel for weather or technical reasons (except in cases of force majeure).
    A 10% commission will be deducted from the price of the ticket sold individually.
    Refunds will only be made at the Gare Maritime ticket office located at 1 quai de la Fraternité – 13001 Marseille on the day of departure or the day after the departure date, on presentation of the tickets, the bank card used to purchase the tickets and proof of payment by internet.
    If the passenger does not show up at the time indicated, no refund or exchange will be made by RTM.

    h) Liability and warranties related to the use of the site
    It is not guaranteed that the site is free of anomalies, errors or bugs, nor that these can be corrected. Likewise, it is not guaranteed that the site will function without interruption or breakdown, nor that it is compatible with any particular equipment or configuration other than that expressly validated by RTM.
    The Client declares that he/she is aware of the characteristics and limits of the Internet, in particular its technical performance, the response times for consulting, querying or transferring data and the risks associated with the security of communications.
    The Client declares that it has verified that the computer configuration it uses does not contain any viruses and that it is in perfect working order.

    i) Proof
    It is expressly recognised that the online provision of the bank card number and, in general, the final confirmation of the order by the Customer is proof of the entire transaction in accordance with the provisions of Law No. 2000-230 of 13 March 2000, as well as of the due date for payment. This confirmation is equivalent to the signature and express acceptance of all operations carried out on the online sales site.

    j) Intellectual property
    The elements accessible on the site, in particular its interface, brands, texts, images, photographs, maps, sounds and videographies are protected by intellectual property rights.
    The reproduction or representation of all or part of one of these elements is strictly forbidden without the prior written authorisation of the right holder.

    k) Protection of personal data
    Pursuant to the legislation on the protection of personal data (in particular Law No. 78-17 of 6 January 1978 on information technology, files and freedoms, as amended, and the General Regulation on the Protection of Personal Data of 27 April 2016), the information requested from the Client and which is contractually binding is specified at the time of collection; failure to provide such information by the Client makes it impossible to process the Order. The legal basis authorising RTM to process the Customer’s information is the performance of pre-contractual measures and the contract for the sale of transport tickets.
    Additional information may be requested, the answers to which are optional and based on your consent to provide them. This additional data may be used to improve our knowledge of customers using the network. Failure to provide such data shall not prevent the Order from being placed.
    All of the Customer’s personal information is intended for use by the Régie des Transports Métropolitains, which is responsible for processing the data and whose head office is located at 79 boulevard de Dunkerque 13002 Marseille, as well as its subcontractors involved in the technical and commercial management of order processing.
    They will be kept for the time necessary to process the Customer’s Order and will be deleted two years after the date of closure of the processing of your last request.
    In accordance with the provisions of Articles 12 to 23 of the General Data Protection Regulation, any person concerned has a right to information, a right of access, rectification, deletion and portability of data concerning him or her, as well as a right to oppose commercial prospecting, a right to oppose and limit the processing of his or her data under the conditions provided for by the regulations. It is specified that the Customer is not profiled or subjected to automated decision-making and that his personal data is not hosted or transferred outside the European Union. Any person may also arrange the fate of his/her personal data by providing instructions to RTM on what should happen to it in the event of his/her death.

    For reasons of traceability, and in order to guarantee the confidentiality of everyone’s data (fight against identity theft), no oral request will be processed. In case of doubt about your identity, you will be required to present valid proof of identity (or to send a signed copy of a valid proof of identity with the signature of its holder).
    If you believe that your data is being processed by RTM in breach of its legal and regulatory obligations in this regard, you have the right to lodge a complaint with the Commission Nationale Informatique et Libertés (CNIL).

    7. Use of tickets
    The acquisition and use of a ticket implies knowledge and acceptance of the stipulations set out in this article.

    a) Behaviour
    In order to travel legally on the RTM boat, the Client must be in possession of a valid ticket.
    The ticket must be presented at the time of boarding. It will then be scanned by a member of RTM staff.
    An access will be dedicated to passengers in possession of tickets purchased online.
    The ticket must be kept in good condition throughout the journey, i.e. until you get off the boat.
    It is also forbidden for any passenger to use a ticket under irregular conditions (and in particular contrary to the general conditions of use specific to the tickets used), to use a ticket that has been modified or presented in any way likely to encourage fraud, or to resell tickets.

    b) Checking tickets
    All staff authorised to carry out checks may check tickets at any time during the journey.
    Customers must present their valid ticket, accompanied by the necessary supporting documents if necessary, during this check. Refusal to present a ticket or proof of identity constitutes an obstruction to the control and may be fined.

    8. Boarding
    Passengers must present themselves at the latest 15 minutes before the departure time.
    Any passenger, even with a ticket, who does not show up within this time limit, will have no recourse against RTM if he/she cannot board and will remain liable for the fare.
    All passengers, including children (from 1 year old) travelling free of charge, must be in possession of a valid ticket to board.
    Passengers must keep their ticket for both the outward and return journeys in order to be able to present it at any control.

    9. Validity of tickets
    The ticket is only valid for the date and time of departure indicated.
    For all tickets purchased on the Internet, the return journey must be made on the same day, the return times remaining free.
    After this time, the ticket will become null and void, and no refund of the ticket can be requested.

    10. Cancellation or delay of a crossing
    In accordance with the texts applicable to maritime transport, if the departure of a vessel is prevented by an event not attributable to RTM (e.g.: diversion, weather, etc.) RTM declines all responsibility for the direct or indirect costs and prejudices caused by these modifications.
    RTM cannot be held responsible for the non-correspondence of departures and arrivals of boats with any other means of transport.

    11. reservations on the line’s timetable
    Only groups of more than 10 people can make reservations.
    It is best to book as early as possible. Reservations are free of charge, accepted by email or online at https://prod.lebateau-frioul-if.fr. A booking form is sent to the Client. Reservations only become definitive after written confirmation (signed return of the reservation form).
    Payments are made on the day of the trip, by cheque, credit card or cash. Payment by invoice is only possible if an original order form on headed paper or vouchers issued by a travel agency is handed in before boarding.
    For groups with a large number of passengers, the Company may split the group over several departures.
    Seats are not numbered or assigned.
    Return times are not guaranteed for group bookings. Boarding may be delayed if the ship’s total capacity is reached.

    12.Capacity
    The Customer declares that he/she has the capacity to validly accept the General Conditions, i.e. that he/she has reached the legal age of majority and is not under guardianship.

    13 Right of withdrawal
    The principle of the right of withdrawal is set out in the Consumer Code (Article L.121-20). However, this does not apply to transport tickets. Indeed, Article L.121-20-4 provides that the provisions on the right of withdrawal do not apply in the case of “the provision of transport services which must be supplied on a specific date or at a specific time”, such as travel.

    14. Liability
    RTM’s liability is limited to the texts applicable to maritime transport. The compensation that may be awarded is limited by these texts.

    15. Complaints

    Any complaint against RTM must be made within 15 days of the journey.

    16.Duration
    These General Conditions apply for the duration of the online ticket sales service, until a new version of the General Conditions is published.

    17 Disputes and jurisdiction
    These General Conditions are governed by French law.
    Any dispute arising from the application of the General Terms and Conditions shall be subject to the jurisdiction of the French courts. For any dispute with customers who have contracted as merchants within the meaning of Article 48 of the Code of Civil Procedure, only the Courts of Marseille shall have territorial jurisdiction.
